1. I acknowledge that I am submitting the Submitted Material voluntarily, on an unsolicited basis, and not in confidence, and that no confidential, fiduciary or any other relationship or obligation whatsoever is intended or created between us by the submission of the Submitted Material. Nothing in this Agreement, nor the submission of the Submitted Material, shall be deemed to place C.A. Acquisitions DBA "PREVAL" or it's employees in any different position from any other member of the public with respect to the Submitted Material. Accordingly, PREVAL or its employees may use any part of the Submitted Material that any member of the public freely could use without liability to PREVAL.

2. I warrant that I have originally created the Submitted Material and that such Submitted Material is free from all claims or encumbrances and that no one else to my knowledge has any right in and to the Submitted Material. I believe the Submitted Material and its features and elements to be unique and novel.

3. I hereby grant to you permission to use the Submitted Material for any reason. You are also permitted to record or photograph the same, and you may use and distribute such recording or photographs in perpetuity without limitation, including over the Internet, and without any obligation, provided that such use is non-derogatory. I further consent to the use of my name, image, voice, biography, appearance or likeness as they may appear at the Submitted Material and in the recordings or photographs, provided that any such use is non-derogatory.

4. I warrant that exploitation of the Submitted Material by you will not infringe upon or violate the personal and/or property rights of any person or entity, including but not limited to copyright, trademark, or the rights of privacy or publicity.

5. I acknowledge that PREVAL is not required nor have any obligation to exploit, accept or use the Submitted Material and may in your sole discretion, remove or refuse to accept, use or do anything at all with respect to the Submitted Material. Preval is not obligated to offer me any compensation, credit or other consideration for the Submitted Material or the permissions granted hereunder.

6. I agree that PREVAL assumes no liability or responsibility to me resulting from my participation in or attempt to participate. PREVAL is not responsible for incorrect or inaccurate Submitted Material.

7. I agree to release and hold harmless PREVAL, its parent companies, affiliates and subsidiaries, officers, directors, employees or agents, PREVAL sponsors from any and all claims, rights, encumbrances, liens, demands, actions or suits, including without limitation claims for copyright infringement, defamation, libel, slander, invasion of privacy, right of publicity, emotional distress or economic loss or any other cause of action or legal claim, arising from use or nonuse of any portion of the Submitted Material by you or any third party. I further agree to indemnify and hold you harmless from any potential or actual claim, action, suit, demand or damage, including reasonable attorneys' fees, asserted by any third party in connection with the Submitted Material due to or arising out of my breach or claimed breach of this Agreement or any violation or claimed violation by me of any laws or rights of any third party, including without limitation, any and all claims for invasion of privacy, right of publicity, defamation (including libel and slander), false light and any other personal and/or property rights.

8. I have read and understand this Agreement and no oral representations of any kind have been made to me.
